Clarity Property Services respects your privacy and is committed to handling your personal information responsibly, securely and transparently. This policy explains how Janina Tregambe trading as Clarity Property (Clarity Property Services, ABN 43 768 779 680) collects, uses, holds and discloses personal information.

Information we collect

We may collect personal information that you choose to provide to us, including your name, email address, telephone number and information you provide when making an enquiry, requesting a resource or engaging with our services.

We aim to collect only the information reasonably necessary to provide our services, respond to enquiries and operate Clarity Property Services.

How we use your information

We may use your personal information to:

• provide requested resources, such as the Clarity Checklist
• respond to your enquiries
• communicate with you about services you have requested or expressed an interest in
• provide and improve our property guidance and related services
• manage our client and business relationships
• send occasional property insights or Clarity updates where you have chosen to receive them
• meet applicable legal, regulatory and professional obligations.

We will not sell your personal information.

Identity verification and anti-money laundering obligations

As a real estate professional, Clarity has obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth). Before providing certain services, we are required to verify your identity and may collect information such as your full name, date of birth, residential address, identity documents and, where relevant, information about beneficial ownership or the source of funds.

We use this information to meet those legal obligations, including customer due diligence and ongoing monitoring. We keep these records for the period required by law, generally at least seven years, and store them securely. We may be required to report certain information to AUSTRAC, and in some circumstances the law does not allow us to tell you that a report has been made.

Marketing communications

We will only send you electronic marketing communications where we have an appropriate basis to do so.

Where you have expressly opted in to receive Clarity insights and updates, you may withdraw your consent at any time by using the unsubscribe facility provided in our communications or by contacting us.

Requesting a Clarity resource does not require you to subscribe to ongoing marketing communications.

How we protect and disclose information

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

We use trusted technology and service providers to operate our website, communications and business systems. These currently include Microsoft 365 (email, calendar and Microsoft Bookings for appointments), Netlify (website hosting and website forms), Google Analytics (website statistics) and Dropbox (secure document storage). Where personal information is handled by service providers, we take reasonable steps to ensure it is handled appropriately.

Some of these providers may process or store information outside Australia, including in the United States. We take reasonable steps to ensure personal information is handled consistently with the Australian Privacy Principles.

We may also disclose personal information to others involved in your property transaction with your consent, such as conveyancers, lenders or other agents, or where we are required or authorised by law.

Access and correction
